Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Watt Wave Live mobile application ("the App") operated by Mantleworks PTY LTD doing business as Watt Wave Live Pty Ltd ("we," "us," or "our").
Acceptance of Terms
By downloading, installing, or using our App, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, you must not use our App.
User Accounts
When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account.
Subscription and Billing
Certain features of the App require a paid subscription. Subscription fees are charged in advance on a monthly or annual basis. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
All payments are processed through Stripe or the Apple App Store or Google Play Store, and are subject to their respective terms and conditions regarding payment processing.
Intellectual Property
The App and its original content, features, and functionality are owned by Watt Wave Live and are protected by Australian and international copyright, trademark, and other intellectual property laws.
User Content
By uploading content to our App, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and distribute such content for the purpose of providing and promoting our services.
You represent and warrant that you own or have the necessary rights to the content you provide and that the content does not infringe upon the rights of any third party.
Prohibited Uses
You agree not to use the App:
- In any way that violates any applicable federal, state, local, or international law or regulation
- To transmit or procure the sending of any advertising or promotional material without our prior written consent
- To impersonate or attempt to impersonate the Company, a Company employee, or another user
- To engage in any other conduct that restricts or inhibits anyone's use of the App
Limitation of Liability
To the maximum extent permitted by law, in no event shall Watt Wave Live be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
Disclaimer
Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
Governing Law
These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
